- About This Agreement
- This agreement sets out the terms and conditions on which we provide you with the E-Smart online money transfer services.
- The terms and conditions clarify who we are, how we will provide the ‘money transfer’ service to you, how this agreement may be changed or ended, what to do if there is a problem, and other important information.
- When using the Transfer Service, you agree to both these terms and conditions, as well as the Terms and Conditions for Use of the E-Smart Website and Mobile Phone Application, which can be found at e-smartmoney.co.uk.

You, the “Client” is required to read and fully understand the terms and conditions set out below, in order to be able to use our services. The terms "you" and "your" refer to the person who accepts and agrees to the terms and conditions of this Agreement.
Definitions
In these Terms and Conditions
- “Card Issuer” refers to the issuer of a Bank Card.
- "Service Provider" means a local bank, money exchange house, or other third-party service providers in the Destination Country with whom E-Smart Money Limited works in providing the Service.
- “Payment Method” include bank card, bank account, and other payment methods.
- “Services” means all payment services and related products available through the Website and App.
- “Destination Country” means the country in which the Recipient receives money through the Service.
- “Prohibited Purpose” refers to any unlawful purpose.
- “Sender” refers to the person who initiated a money transfer.
- “Recipient” refers to the person named as the beneficiary of the money transfer
- "Bank Card" Any Visa® or MasterCard® credit card, or a debit card to be used for the transaction.
- "Transfer" means a specific instruction to send money through the Service.
- "Transfer Amount" means the amount of money that the Sender wishes to send to the Recipient, excluding any applicable fees and prior to any foreign exchange conversion.
- "Transfer Fee" means the fee including. any additional charges applicable to each Transaction.
- "Pay-out Amount" means the amount paid out to the Recipient, after any foreign exchange conversion and excluding Local Taxes.
- About E-Smart Money
- The online money transfer services are provided by E-Smart Money Limited, trading as E-Smart Money (“we”, “us” or “E-smart Money”), a company established in England with its registered office at 182 Uxbridge Road, London, W12 7JP, United Kingdom (company number 12116793).
- E-Smart Money is a payment institution authorised and regulated by the Financial Conduct Authority (FCA) for the provision of payment services (reference number 917920). The Financial Conduct Authority (FCA) can be contacted by post at The Financial Conduct Authority, 12 Endeavour Square, London, E20 1JN, or by phone on 0800 111 6768, or by email at queries@fca.org.uk.
- These terms and conditions apply only to money transfers initiated online through our website, www.e-smartmoney.co.uk (the “Website”), or our mobile phone application (the “App”), by a natural person or business in the United Kingdom (a “Sender”).
- The E-Smart Money Transfer Services (Terms of use)
- Through the Website or the App, the E-Smart Money Transfer Service allows a Sender to make a transfer of money as a single payment transaction (a “Transfer”) to an individual outside the United Kingdom and designated by the Sender.
- You must be 18 years old or over to use the E-Smart Money Transfer Service.
- The Sender, the “Client”, “You”, if using the service for the first time, would need to create a profile on the “Website” or “App” - where we will request documents to help identify and verify You.
- The Transfer may only be received in the countries where we operate (“Supported Countries”), and the Transfer may only be made into one of the currencies designated by us (the "Supported Currencies") specific to the destination country. A list of the Supported Countries and Supported Currencies may be found at e-smartmoney.co.uk and on the App.
- The E-Smart Money Transfer Service may only be used to make a Transfer to a Recipient that is able to enter legally binding contracts under applicable law, including local law in the jurisdiction in which the Recipient lives.
- The E-Smart Money Transfer Service may not be used for any illegal purpose, including, but not limited to:
- transferring or receiving funds for the purpose of financing illegal activity;
- a transfer of money that constitutes money laundering or terrorist financing under applicable law, or is obtained through illegal activity;
- transfer funds for the purpose of avoiding the seizure of the funds by law enforcement or by court order, or for tax evasion purposes.
- E-Smart Money Limited offers various options for the receipt of funds: cash pick up at an agent location, direct to a bank account, or to a mobile phone - where available.
- For the receiver to get the funds paid out in cash, the Receiver must provide sufficient proof of his or her identity in addition to providing all details of the Transfer, required by E-Smart Money Limited.
- For security reasons, E-Smart Money Limited has an obligation to screen every Transaction and Transfer to be processed. All different parties are checked against lists of names provided by the governments of the countries and territories in which “We” carry out our operations, including in the UK and the European Union. If a possible match is identified, E-Smart Money Limited reviews the Transaction fully to determine if the name matched is indeed the individual on the relevant list.
- For Transfer services, in some countries, the service may be delayed or other restrictions may apply. If the delay that occurs is not caused by us, then E-Smart Money will not be responsible for this delay and is not held liable. It may take up to 2 working days for the funds to become available for collection, depending on the business hours of the respective agent location. - We aim to make funds available for collection by the Receiver at the latest at the end of such Business Day following the Business Day on which the funds were received by us - Subject to statutory or regulatory requirements.
- “Your” (the Client’s) Responsibility to E-Smart Money
You acknowledge and consent to the following:
- Any information given with an effect on the Transfer is accurate and complete – matching any official ID or documentation (i.e. passport/driving license) used. You, the “Sender” are responsible for the details provided.
- You shall not use E-Smart Money Limited for illegal purposes.
- We may forward certain information about You and about the services that We provided to You if necessary to regulatory or government authorities or their bodies if: we are obligated by law to do so; or if we believe that such a disclosure may assist in the prevention of fraud, money laundering or other crimes.
- To share all the information required for the Transfer (amount of money, Your name, Your country, name of Receiver, and MTCN) with the Receiver only. It is your responsibility and obligation to ensure that no third party can gain unauthorised access to this information. We recommend that you transfer money only to beneficiaries that You know personally.
- You will not request money transfers that breach these Terms and Conditions or any other restrictions of use or terms of use as set forth on the E-Smart Money Limited Website and App.
- Fees must be paid in full for every money Transfer You initiate via the use E-Smart Money Limited, otherwise, the Transfer would not get authorised and would not get initiated.
- E-Smart Money’s Responsibility to you, the “Client”
To provide you the E-Smart Money Transfer Services in the form of individual payments - exercising reasonable care and ensuring it is provided to You in accordance with these Terms and Conditions.
We do not assume any liability for:
- breakdowns and faults in communication facilities over which We have no control;
- goods or services that You pay for using the E-Smart Money Transfer Service, and in particular their delivery;
- delay in transmissions and loss of data caused by using a browser or an Internet service provider or other software that We have no control over;
- viruses originating from third parties;
- the services provided by Your Card Issuer;
- the unauthorized use or interception of information prior to reaching the Website;
- errors on the E-Smart Money Limited Website that are the result of wrong or incomplete information or that You or a third party provided;
- any repercussion caused from the late payment or non-payment of a money transfer to a Receiver
BY ACCEPTING THESE TERMS AND CONDITIONS, AND BY COMPLETING AS WELL AS CONSENTING TO THE INFORMATION REQUIRED TO MAKE A MONEY TRANSFER, THE SENDER INSTRUCTS E-SMART MONEY TO EXECUTE A SPECIFIC MONEY TRANSFER. EVERY INDIVIDUAL MONEY ORDER CONSTITUTES A SEPARATE AGREEMENT BETWEEN E-SMART MONEY LIMITED AND THE SENDER WHICH IS LIMITED TO THE EXECUTION OF A SPECIFIC MONEY TRANSFER.
- Customer Service and Complaints​
E-Smart Money aims to provide the highest level of customer service possible and will always seek to resolve any problems quickly and efficiently.
If a Client/Sender is dissatisfied with the Transfer service or believes that a Transfer has not been correctly carried out, the Client/Sender should notify us as soon as possible in writing by email at info@e-smartmoney.co.uk or by calling us on 0044(0)2087460197.
